LATEEF FAGBEMI GIVES FINAL WRITTEN ADDRESS AS HE IS SET TO BE SWORN-IN NEXT WEEK AS A MINISTER

The Lead Counsel to Hon Nkeiruka Onyejeoocha in the suit filed by Hon Onyejeocha Vs Amaobi Ogah, Lateef Fagbemi,SAN who has just been named as the Attorney General of the Federation and the Honourable Minister of Justice (Designate) Relies on the Mandatory Requirements of Section (77) to ask the Tribunal to disqualify the Member Representing Isuikwuato/Umunneochi,Hon Amaobi Ogah

The three grounds upon which the election petition filed on the 17th day of March 2023 was predicated are as follows:

1.The 3rd Respondent, at the time of the election was not qualified to contest the election;

2.The election of the 3rd Respondent was invalid by reason of non-compliance with the provisions of the Electoral Act, 2022;

3.The 3rd Respondent was not duly elected by the majority of lawful votes cast in the election.

Recall that, Section 77 (1) (2) & (3) of the Electoral Act says a political party shall “ SHALL” maintain a register & SHALL make such register available to INEC not later than 30days before the date fixed for the party primaries, Congresses & Convention.
